BATAVIA, IL — The son of a Batavia woman who was killed after being hit by a car in a Geneva intersection has filed a wrongful death lawsuit against the driver, according to reports from the Daily Herald.
Filed Nov. 10, Sebastian Berke’s four-page complaint, which claims the driver fell asleep at the wheel prior to the crash, seeks more than $50,000 in damages and a jury trial, the news outlet reported.
The suit comes almost two months after Tammy Berke died Sept. 29.

The 55-year-old woman was walking south near the center turn lane on State Street east of Sandholm Street when she was hit by a black 2018 Hyundai Kona driven by a 30-year-old Geneva woman who was driving west on State Street, Patch reported. Tammy was taken to Northwestern Medicine Delnor Hospital where she later died.

An employee at the Valley Animal Hospital, Tammy is remembered by her co-workers as having a “very strong work ethic” and being “a natural with animals,” according to Fox Valley Magazine.
“She did such a great job [when] we hired her to work during the day as a Veterinary Assistant – she was a natural with animals,” Jennie Christakos of Valley Animal Hospital told the publication in an email. “Tammy had a very strong work ethic and came to work every day with a smile on her face. She will be sorely missed at Valley Animal Hospital. Our thoughts and prayers are with Tammy’s family and friends.”
In September, police said the Geneva woman, who was uninjured in the crash, was “fully cooperating” with the investigation, Patch reported. She was cited for failure to reduce speed to avoid an accident.
